Legal issues in Laser Tag
Under federal law, laser tag taggers are not classified as firearms because they don't use spring or compressed air and are legal for all ages. However, a person of any age may use laser tag tagger. But we do not recommend that people under the age of 18 buy taggers without parental consent.
We recommend that for safety purposes, you should have an orange tip of 6 mm (0.24 in.) or longer on the barrel in order to distinguish your tagger from the real firearm during play, shipping and transportation of a tagger that looks-alike or is an imitation of an actual firearm. This is not required by federal law but can be subject to Part 272 of Title 15 of the Code of Federal Regulations. As a precaution, we supply those orange tips for all taggers made for our customers from the US and Canada.
In addition to the orange tip markings, to distinguish an imitation firearm tagger from a real firearm the following can be applied:
- orange barrel plug;
- all-body bright paint coating;
- transparent construction.

Using a laser tag tagger is also the case for the laws in each state (and also depends on your city, municipal laws), as it does for other sports that use imitation firearms.
California. From January 1, 2016, the exterior surface of the device of imitation firearms should be white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink, or bright purple, either singly or as the predominant color in combination with other colors in any pattern, or the entire device should be constructed of transparent or translucent materials which permits unmistakable observation of the device’s complete contents. New York City. Realistic toy or imitation firearms or replica firearms should be marked with bright colors and coated plastic unless such a device is imported, manufactured, sold, held for sale and distributed solely for subsequent transportation in interstate commerce. See New York City Administrative Code Title 10 for more details.
Arkansas. Bill claims a device for an imitation firearm should have an orange solid plug or marking that is permanently affixed to the muzzle end of the barrel for a depth of not more than six millimeters (6 mm), or the entire exterior surface should be predominantly colored other than black, brown, blue, silver, or metallic, or it should be constructed of transparent or translucent materials that permit unmistakable observation of the complete contents of the device.
In Washington DC, replica guns are considered illegal according to Washington DC airsoft gun laws.
Also, be most cautious with state laws in Colorado and Illinois.
